Human rights and sovereignty are generally construed as disputatious, if not entirely incompatible; the liability of the former constrains the license of the latter. Despite the differences in governmental structure to which each attaches sovereignty, each disassociates sovereignty from its agents who does the work of supreme authority and aligns it to its end the good of citizens. Don't have an account? This chapter focuses on the interplay between sovereignty and human rights. It begins with a brief account of the classical conceptualizations of each, insisting on the distinction between internal and external sovereignty in international law. Human rights are fundamentally concerned with the relations between states and their nationals; precisely the area previously thought to have been reserved most emphatically to the freedom of the former. The coexistence of the two has not been easy; more often than not the two principles have confronted rather than partnered. By definition, Human Rights give the basic liberties and freedoms entitled to all simply because of being human. This principle of rights due rational, moral beings is not a new concept.

This article examines the impact of the principle of state sovereignty on the enforcement of international human rights law. It contends that while state sovereignty may still be an obstacle to the implementation of human rights and fundamental freedoms within many municipal legal systems, governments that engage in serious violations of the internationally accepted human rights norms will inevitably bear the brunt of their unbecoming laws and practices. This article also argues that state sovereignty is thus no longer an absolute right and that its implementation has become subordinate to the values imbedded in the human rights doctrine.
